Terms of Service

Effective October 9, 2026

Who we are

Foyer (“Foyer”, “we”, “us”) is based in Chicago, Illinois. Foyer adds a booking widget, a one-page website, deposits, memberships, packages, promo codes, automations and email tools to businesses that use Square Appointments. These terms apply to anyone who creates a Foyer account (“you”). Questions: cullin@foyerkit.com.

Your account

  • Foyer is for businesses. You must be at least 18 and able to agree to these terms for your business.
  • Keep your sign-in details safe. You are responsible for what happens in your account.
  • Give us accurate information, including a working email address.

Square

Foyer works on top of your Square account. You connect it through Square’s own sign-in, and you can disconnect it at any time from Foyer or from your Square Dashboard. Square’s terms still apply to your Square account, and Square processes the payments your clients make. Foyer is not affiliated with Block, Inc. Square and Square Appointments are trademarks of Block, Inc.

Plans, billing and founding prices

  • Foyer is a paid subscription, billed in advance each month or year through Stripe. Plans renew automatically until you cancel.
  • Prices are shown on our pricing page and at checkout, before taxes where they apply.
  • Founding prices go to the first 25 businesses that choose a monthly plan. A founding price stays yours while your subscription stays active, including if you switch between Foyer and Foyer Growth.
  • If we change regular prices, we will email you at least 30 days before the change reaches your bill.
  • Features marked “Coming soon” are not yet available and are not part of what you pay for until they launch.

Cancelling and failed payments

  • You can cancel at any time from Billing in your dashboard. Your plan runs to the end of the period you have paid for. Refunds are covered in our Refund Policy.
  • If a payment fails, Foyer keeps working for 7 days while you update your card. After that, the dashboard only shows Billing and online booking pauses until a payment goes through. We do not delete your account or data because a payment failed.

Your business and your clients

  • You are responsible for your services, prices, deposit and cancellation policies, and for following the laws that apply to your business, including any rules on cancellation fees.
  • Money your clients pay goes to your Square account. Foyer is not a payment processor and does not hold your funds.
  • You own your data and your clients’ data. We use it only to run Foyer for you, as described in our Privacy Policy.

Email and the newsletter

Only email people who agreed to hear from your business. When you import a list, you confirm that everyone on it gave you permission. Every newsletter includes an unsubscribe link and your business address, and we honor unsubscribes for your business automatically. We may pause sending if bounces or spam complaints suggest a list was not collected with permission.

Acceptable use

Do not use Foyer to break the law, send spam, collect data you are not allowed to collect, interfere with the service or other customers, or try to get around security or plan limits. We may suspend accounts that do, and will tell you why.

Changes and availability

We improve Foyer often and may change or remove features. We will tell you ahead of time about changes that take away something you pay for. We work to keep Foyer running at all times but cannot promise it will be uninterrupted or free of errors.

Warranties and liability

Foyer is provided “as is”. To the extent the law allows, we disclaim implied warranties, and our total liability for any claim relating to Foyer is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits or indirect damages. Nothing here limits liability that cannot be limited by law. You agree to cover claims that come from your use of Foyer in breach of these terms or the law.

Ending the agreement

You can close your account at any time by cancelling your plan and emailing cullin@foyerkit.com. We may end these terms if you seriously break them, with notice where we reasonably can. After closing, you can ask us for a copy of your Foyer data for 30 days.

Law and changes to these terms

These terms are governed by the laws of the State of Illinois, and disputes go to the state or federal courts in Cook County, Illinois. If we change these terms in a way that matters, we will email you before the change takes effect. Using Foyer after that means you accept the updated terms.
